ACTIVITIES OF LABOUR DEPARTMENT UNDER VARIOUS LABOUR ACTS

INDUSTRIAL DISPUTES ACT, 1947
I Industrial Complaints
On receipt of complaints concerning layoff, dismissal, bonus, wages, emoluments, leave, holidays, work conditions, demand charter, etc. either from worker or from a union, along with a factual description in two copies the conciliation officer seeks comments of the employer and holds conciliation to dispose off complaint.
II Industrial Disputes
When industrial peace is threatened due to either normal industrial disputes between workers and the employers or due to strikes, seige, lockout, etc., the conciliation officer acts with speed to bring about & maintain industrial peace. In case an agreement is reached between the parties the agreement is registered and in case of disagreement the failure report of conciliation proceedings is sent to the state government for further necessary action.
III Work done at the level of state government
· If parties agree the dispute may be referred to arbitration and Board of Conciliation.
· Dispute is sent to labour court/industrial tribunal/National authority for decision.
· Order may issued under sections 10(3) and under 10(k) to maintain industrial peace as per the circumstances.
· If the dispute is not sent or judicial decision parties concerned are informed accordingly.
· To publish notifications of award of Labour Courts/Industrial Tribunals.
NOTE
Labour Inspectors, Labour Welfare Officers, Asstt/Dy/Jt Labour Commissioners posted in labour offices of various districts of state are conciliation officers under the Act.
MINIMUM WAGES ACT, 1945
· The Act is applicable on 61 scheduled employments including agriculture:
Minimum Wages currently is:
(i) Unskilled-Rs.60 per day
(ii) Semiskilled-Rs.64 per day
(iii) Skilled-Rs.68 per day

PAYMENT OF WAGES ACT, 1946
· Applicable on workers getting wages upto Rs.1600 per month.
· Workers entitled to get due wages within stipulated time.
· Worker entitled to get up to ten times of the total wages as per circumstances in case of non payment or illegal deduction.
· Worker entitled to get due wages along with damages in case of late payment.
PAYMENT OF BONUS ACT, 1965
· Applicable on all institutions, wherein a single accounting year ten or more workers have been employed with use of power and where twenty or more workers have been employed without use of power.
· Applicable on worker getting upto Rs.3500 per month.
· Bonus due after completion of five years of the establishment of the unit or even before in case of profit. But in any case due as per Act from the sixth year payable according to the profits subject to minimum of 8.33% and maximum of 20%.
PAYMENT OF GRATUITY ACT, 1932
· Applicable on every industry where ten or more workers are employed.
· Every worker who has been working continuously for more than five years has a right to receive gratuity, within 30 days of removal or retirement.
EQUAL REMUNERATION ACT, 1976
· Applicable on all educational institutions, schools, nursing homes and other scheduled employment.
· Every female worker has a right to get the same wages as a male worker for doing similar work.
MOTOR TRANSPORT ACT, 1961
· Applicable on all motor transport institutions employing two or more workers.
· Workers are entitled to get payment on time, weekly off, and double wages for over time.
· Workers between 14 years and 18 years of age shall work for maximum period of 8 hours including half hour rest.
· Non adult worker shall get one days paid leave after every 15 days while adults workers shall get the same after 20 days.
· Workers entitled to get facility like canteen, rest room, medical aid, uniform, etc.
CONTRACT LABOUR(REGULATION AND PROHIBITION)ACT, 1970.
· Applicable where twenty or more workers are employed by a contractor.
· Contract labourers are entitled to get the same kind of wages and work conditions as regular workers for doing similar kind of work.
· Contract labourers entitled to get wages on time, double wages for over time, canteen, medical aid facility, etc.
CHILD LABOUR (REGULATION AND PROHIBITION)ACT, 1986
· A child labour is one who has not completed the age of fourteen years and works for wages.
· Child labour is totally prohibited in hazardous occupations and regulated in non hazardous occupations where a child shall not work for more than six hours in a day and shall receive 1 hour rest after every 3 hours in a day & shall work between 7 p.m. and 8 p.m. only.
· Child labourers can not do over time, shall receive weekly off and have a right to education and rehabilitation.
WORKMEN'S COMPENSATION ACT, 1923
· Any worker has a right to seek damages in case of accident while working. In case of death of the worker his dependents have right to claim damages.
· Employer has liability to pay damages within 30 days of accidents.
· In case of non payment, claim can be made before competent authority.

TRADE UNION ACT, 1926
· Any group of seven or more workers of an institution have a right to come together and form a Trade Union.
· Trade Union has right to act for the individual and/or for collective benefit of workers at different levels.
BEEDI AND CIGAR WORKERS(CONDITION OF EMPLOYMENT)ACT, 1966
· Workers have a right to get wages on time, weekly off, paid leave, and double wages for over time.
· A worker shall not work for more than nine hours without over time and for more than ten hours with over time including rest period.
· Female and teenagers shall work between 6 a.m. to 7 p.m. only in a day.
· Employment of child labourers is prohibited and all workers are entitled to clean air and water, clean lavatory, creches, medical and canteen facility, etc.
INDUSTRIAL EMPLOYMENT (STANDING ORDER)ACT, 1946
· Applicable on all institution where 50 or more workers are employed.
· Both workers and employer are entitled to get rules related to service conditions of workers formed amended and certified in the form of standing orders.
INTER STATE MIGRANT WORKERS (EMPLOYMENT AND REGULATION OF SERVICE CONDITION)ACT, 1979
· Applicable on any institution employing five or more migrant workers.
· Migrant workers are entitled to the get the same wages and working conditions as other workers doing similar work.
· Migrant worker are entitled to get displacement allowance at the time of appointment and travelling expenses from native place to place of work.
· Journey period of migrant workers shall be treated as working period during journey to place of employment.
SALES PROMOTION(CONDITIONS OF EMPLOYMENT) ACT, 1976
· Applicable on industrial units producing medicines.
· Right to get appointment order and accumulate leave and half pay leave.
· Right to get all due benefits under Industrial Disputes Act, Minimum Wages Act, Payment of Gratuity Act.
WORKING JOURNALIST AND OTHER WORKERS(CONDITION OF EMPLOY-MENT) AND OTHER PROVI-SIONS ACT, 1955
· Entitled to get wages as decided by central government.
· Entitled to get gratuity as per law, weekly, causal, accumulated and half pay leave.
RAJASTHAN SHOP AND COMMERCIAL ESTABLISHMENT ACT, 1958
· Applicable on shops, commercial establishments, hotels, restaurants, theaters, etc. in scheduled areas.
· Workers, entitled to get due wages as per law, weekly off, paid leave, double wages for over time, etc.
· Workers can not be removed from service, without just reason, after working for six months or more on application of sec.28(A).
BONDED LABOUR SYSTEM(ABOLITION) ACT, 1976
· Bonded Labour of a person in any form is totally prohibited.
· Vigilance Committee have been formed at District & Sub-division level to put a check on Bonded Labour.
· Rehabilitation worth Rs.20,000/- provided to a released bonded labourer.
